The new year brings new vaping restrictions to Kentucky

Last year’s HB11 proposed a ban on the sale of most disposable vapes and vape juices, with the stated aim of keeping them out of the hands of minors. The new state law, which kicked in January 1st, restricts the sale of vapes to only those that have been authorized by the FDA or are pending authorization.

A product receiving FDA certification is not the same thing as being FDA-approved. Authorization allows a product to be marketed for sale - and the FDA has denied marketing to over one million flavored nicotine devices.

Right now, the only products authorized for sale are tobacco and menthol products from makers Logic, NJOY, and Vuse, ruling out the large majority of products sold at vape shops.

The law will be enforced by the state Alcoholic Beverage Control agency. Violations carry a $1000 fine.
