FRANKFORT, Ky. – A Frankfort judge this week will hear preliminary arguments in a lawsuit over Instant Racing at Kentucky horse tracks. Our Tony McVeigh says an intervention motion will be the key issue of consideration.
After the Kentucky Horse Racing Commission approved regulations permitting Instant Racing in the commonwealth, the commission filed a friendly lawsuit testing the legality of its actions.
Now, the Family Foundation of Kentucky is seeking to intervene in the lawsuit. The organization says Instant Racing is nothing more than another form of casino-style gambling prohibited by the state constitution.
Instant Racing involves electronic wagering on previously-run horse races.
Wednesday morning, Franklin Circuit Judge Thomas Wingate will consider the Family Foundation's intervention motion.
In a few weeks, Kentucky lawmakers will take a look at the Instant Racing regulations, and a public hearing will be held at the racing commission.
