Frankfort, KY – Last year, the Kentucky Supreme Court found Marco Allen Chapman competent to enter a plea and permitted Chapman to discharge his attorneys. Public defenders representing Chapman sought a rehearing, which was denied on October 23rd. But prior to that, the attorneys filed two motions seeking a stay of execution.
Chapman told the high court the motions were filed against his wishes and knowledge and asked for dismissal. He has gotten his wish. In a unanimous decision, the supreme court says Chapman is "competent to make his own decisions" and the motions are dismissed.
But writing separately, Justice Mary Noble says she is concurring "only because it is the law and I am sworn to uphold the law of the people. If state executions are not the will of the people, then they must demand a different approach. I would welcome such legislation."
