Plans to locate the clinic in the neighborhood have been controversial from the start, but it was a decision by the board on April 13 that revealed just how high tensions would rise over the development.
Shouts and angry comments greeted the 4-2 vote for a conditional use permit to operate the clinic as concerned residents packed the council chambers and lined up outside. Board of Adjustment member Ross Boggess told the Lexington Herald-Leader he was continually harassed after supporting the project.
Now, neighbors have filed an appeal to have the decision in favor of the Duke Road facility reversed, citing what the plaintiffs argue was a violation of zoning laws. City staff in the Division of Planning have said opponents are misreading the zoning rules and the clinic would be allowable.
The case is set to be heard by Judge Julie Goodman, herself the subject of a contentious impeachment effort in the Kentucky General Assembly.
