New laws take effect in Kentucky



The Team Kentucky Medical Cannabis Advisory Committee

On January 1st, several laws went into play in the Commonwealth, including the legalization of medical cannabis, new requirements for Kentucky drivers, and regulations for vaping products.

Medical Marijuana

Medical marijuana is now legal in the state for a list of approved medical conditions, such as PTSD, cancer, and chronic pain.

Because the product sold in Kentucky must be grown in Kentucky, it could take some time before supply can meet demand.

Governor Andy Beshear said he will keep his executive order in place which allows patients to purchase medical marijuana in other states.

Kentuckians can now get a medical marijuana if:

  • You are a Kentucky resident.
  • You are at least 18 years old.
  • You have a qualifying medical condition.
  • You obtain a written certification from a licensed medical practitioner confirming your condition.
  • You do not have a felony record.

Another new law in Kentucky requires you to take a vision screening test when you renew your driver’s license or permit. The screening can be done at any driver’s licensing office, or you can bring in the results of a test performed by an optometrist.

Lawmakers say they passed the vision screening law to improve driver safety. If you don’t pass the screening, you will be referred to a vision specialist for another exam before your license can be renewed.

Vaping Product Restrictions

And 80-90% of vaping products in Kentucky must be removed from the shelves due to HB 11 which requires all vaping products to be approved or certified by the FDA.

Those who supported HB 11 say it is an attempt to curb youth vaping in Kentucky.
